Terms of Service

Draft notice: these terms were drafted to cover Trace's core functionality and the mandatory clauses required for app-store distribution. They have not yet been reviewed by a lawyer. Treat them as a working starting point, not certified legal advice, until they have been.

Acceptance of terms

These Terms of Service, together with our Privacy Policy, form the complete agreement ("Terms," also serving as the End User License Agreement, or "EULA") between you and Trace governing your use of the app. By using Trace, you agree to these Terms. If you don't agree, please don't use the app.

Eligibility

You must be at least 16 years old to use Trace. By using Trace, you confirm that you meet this requirement.

Acceptable use

You agree not to use Trace to:

• Harass, threaten, stalk, or endanger another person;
• Track, monitor, or attempt to identify another person's real-world identity or location without their knowledge and consent, including a person who has not consented to being followed on Trace at all;
• Use trace links, friendships, or any other Trace feature to follow or keep tabs on someone who hasn't agreed to it, for example by pressuring someone to add you as a friend or to share a trace link with you, or by passing on someone's trace link to people they didn't intend to see it;
• Verify an account with a phone number that isn't yours or that you're not authorized to use;
• Impersonate another person or misrepresent your affiliation with anyone;
• Post spam, or content that is unlawful, hateful, or sexually explicit;
• Interfere with, disrupt, or attempt to gain unauthorized access to Trace's systems.

Trace has zero tolerance for objectionable content or abusive behavior. Accounts that violate these terms may be blocked by other users, reported, and removed at our discretion. Use the in-app Block and Report tools on any account that violates these terms.

We may suspend or terminate your access to Trace, without prior notice, if we believe you've violated these Terms, put another user's safety at risk, or misused the app in a way that harms Trace or anyone else. For serious or repeated violations, we may also ban the phone number used to verify the account, which prevents it from being used on Trace again, even after the account is deleted. A suspended account can still be deleted (see ourPrivacy Policy). If you think a suspension is a mistake, email us.

Your account

Trace accounts are pseudonymous and tied to your device. You're responsible for anything that happens through your account. You can delete your account at any time fromSettings > Legal & Privacy > Delete my account.

To go live and to add friends, you must verify a phone number with a one-time code sent by SMS. Each phone number can be linked to only one Trace account. Phone verification is used to limit spam and abuse; it is not an identity or age check. How we handle your phone number is described in our Privacy Policy.

Your verified phone number is also how you get your account back on a new device: verifying the same number there moves your account, friends, nicknames and blocks to that device and signs the old one out. Anyone who controls your phone number can therefore take over your Trace account, so keep your number secure, and delete your account or contact us before you give up that number.

Location & safety

Trace helps you find other people who are active nearby, but it does not verify the identity, intentions, or safety of any user. Use good judgment when meeting anyone you connect with through the app, and never share more information than you're comfortable with.

Trace links. You decide who you send a trace link to. Anyone holding the link, including anyone it gets forwarded to, can see your approximate position, your pseudonym, your description, and any meetup point you set, until your broadcast ends, without needing an account. Only share a link with people you trust, and end your broadcast if a link reaches someone it shouldn't have. Trace can't control where a link goes once you've shared it.

Disclaimers and limitation of liability

Trace is provided "as is," without warranties of any kind. We do not guarantee that the service will be uninterrupted, error-free, or secure, and we are not responsible for the accuracy of any location or profile data shared through the app. To the fullest extent permitted by law, Trace and its operators are not liable for any indirect, incidental, or consequential damages (including loss of data or service downtime) arising from your use of the app, or for the actions of any third party you interact with through it.

Changes to these terms

We may update these terms as Trace evolves. Material changes will be reflected by an updated "Last updated" date above.

Governing law

These terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.
